The Ministry of Human Resource Development has received a representation from the Ministry of Defence stating that they have received a proposal from Armed Forces-run schools to exempt them from the provisions of Section 12(1)(c) of the RTE Act which provides for 25% admission of children from disadvantaged groups and weaker sections in class I or pre-primary as the case may be, and provide free and compulsory education till completion of elementary education.
The RTE Act is applicable to all schools referred to in section 2(n) of the Act. In respect of residential schools, the applicability of section 12(1)(c) would be limited to day scholars. The Government has also issued a Guideline dated 13th July, 2012 clarifying that the provisions of section 12(1)(c) shall not apply to the residential schools which start admitting children at classes higher than class I. The guidelines may be seen at Ministry’s website www.education.nic.in.
